The LUPAG <br /> designation for the subject parcel is Resort Node and the Project District zoning allows for a <br /> mixture of residential, resort, commercial and recreational uses. Moreover, the <br /> project continues to be consistent with goals, policies and actions articulated in the Land Use <br /> and Economic elements of the General Plan. In addition, land use policies in the <br /> 2008 Kona Community Development Plan (KCDP), direct urban growth into compact, <br /> mixed-use communities that provide a mix of uses, services and amenities in the same <br /> development. The Kaupulehu Project District is guided by Director approved Master Plans <br /> that are consistent with this preferred development pattern. <br /> The original reasons for the approval of the Project District Ordinance are still <br /> applicable, and the time extension request is not contrary to these reasons. The proposed <br /> uses continue to be an appropriate use of lands within the Project District and the remaining <br /> development is consistent with the surrounding land use pattern. Moreover, the <br /> infrastructures and facilities will remain privately developed and managed, so continued <br /> development will not place undue burden on the County to provide those services. Plans for <br /> future development of the Property have not significantly changed since the Planning <br /> Commission and County Council originally approved the subject ordinance, so the requested <br /> amendment would not be contrary to the original reasons for granting Project District <br /> Ordinance 99 42. <br /> Lastly,this approval is made with the understanding that the applicant remains <br /> responsible for complying with all other applicable governmental requirements in <br /> connection with the approved use, prior to its commencement or establishment upon the <br /> subject properties. Additional governmental requirements may include the issuance of <br /> building permits, compliance with the Fire Code, installation of improvements required by <br /> the American with Disabilities Act(ADA), among many others. Compliance with all <br /> applicable governmental requirements is a condition of this approval; failure to comply with <br /> such requirements will be considered a violation that may result in enforcement action by the <br /> Planning Department and/or the affected agencies. <br /> Based on the preceding, the Planning Director recommends that a favorable <br /> recommendation be forwarded to the County Council to amend Project District <br /> Ordinance No. 99 42. In addition, the Planning Director recommends revision of some <br /> existing conditions in the ordinance to reflect current standard language for conditions of <br /> approval. The accompanying draft bill reflects these recommendations and changes. Material <br /> to be deleted is bracketed and struck-through; new material is underscored. <br />
