HKI Kawili LLC is consulting with the <br /> County Office of Housing and Community Development to obtain Hawai`i Revised <br /> Statutes Section 201H status for exemptions from zoning code and ordinance condition <br /> requirements for the affordable housing project. <br /> CONDITION C <br /> The non-performance is the result of conditions that could not have been <br /> foreseen or are beyond the control of the applicant, successors or assigns, and that <br /> are not the result of their fault or negligence. The applicant requests a 10-year time <br /> extension to complete construction of the proposed development. The applicant has made <br /> substantial progress towards completing the project since the property was rezoned in <br /> 2007. They have grubbed and rough graded the property, final graded Parcel 30, <br /> maintained the property on an on-going basis, constructed a two-lane access <br /> driveway/box culvert off of Kawili Street onto Parcel 31 to serve both the proposed <br /> affordable housing community and CVC/CBOC project, installed sewer stub-outs to <br /> serve both projects, and secured the property with fencing and gates. They have also <br /> partnered with EAH/HKI Kawili LLC for the development of the affordable housing <br /> project and have secured grant funding from the State for design of the CBOC project. <br /> The applicant will seek Final Plan Approval for the project components upon the <br /> successful amendment of the ordinance, and expects to commence construction of the <br /> affordable housing project in 2020, upon securing project financing and subsidies. <br /> Approval of the time extension request to comply with Condition C would <br /> not be contrary to the General Plan or Zoning Code nor the original reasons for <br /> granting the Change of Zone. There have not been any significant changes to the <br /> General Plan or Zoning Code for this area since the subject rezone was approved in 2007. <br /> At that time the General Plan LUPAG Map designation for the property was the same <br /> that it is today, High Density Urban. This designation includes uses such as general <br /> commercial, multiple-family residential at a density of up to 87 units per acre, and related <br /> services. The current RM-1 zoning district is consistent with the General Plan LUPAG <br /> Map designation and compatible with the surrounding land uses which are a mix of <br /> residential, commercial and educational uses. <br /> This favorable recommendation is made with the understanding that the applicant <br /> remains responsible for complying with all other applicable governmental requirements <br /> in connection with uses permitted within the Multiple-Family Residential zoning district, <br />
