• <br /> • BFukuharaAmendREZ.jwd 11/23/18 <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> BACKGROUND REPORT <br /> NELSON AND SUSAN FUKUHARA <br /> AMENDMENT TO CONDITION C <br /> CHANGE OF ZONE ORDINANCE NO. 97 13 (REZ 843) <br /> NELSON AND SUSAN FUKUHARA (formerly John S. Jr. and Linda Tolmie) are <br /> requesting a 5-year time extension to comply with Condition C (Complete Construction) of <br /> Ordinance No. 97 13, which changed the zoning of 21,164 square feet of land from the <br /> Single-Family Residential-10,000 square foot (RS-10) zoning district to the General <br /> Commercial-20,000 square foot (CG-20) zoning district in 1997. The subject property is located <br /> on the southeast side of the Kino`ole Street-Kamana Street intersection, Waiakea, South Hilo, <br /> Hawai`i, TMK: (3) 2-2-023:012. <br /> PROPOSED ACTION <br /> 1. Request: The applicants are requesting a 5-year time extension to comply with <br /> Condition C of Change of Zone Ordinance No. 97 13, which states: <br /> "Construction of the proposed commercial development shall be completed <br /> within five (5) years from the effective date of this ordinance. Prior to the start of <br /> construction, Final Plan Approval for the proposed commercial development and <br /> related improvements shall be secured from the Planning Director. Plans shall <br /> identify structures, fire protection measures,paved parking stalls and paved <br /> driveway and other improvements associated with the proposed use. Plans shall <br /> include landscaping along property boundaries, for the purpose of mitigating any <br /> potential adverse noise and visual impacts to adjoining parcels and the <br /> intersection." <br /> This condition required that construction of the proposed commercial development be <br /> completed by February 20, 2002. The applicants purchased the property from the <br /> previous applicants just before the original ordinance was approved. The applicants did • <br /> • not request an administrative time extension from the Planning Director as allowed by <br /> Condition H. The applicants are requesting a 5-year time extension from the date of <br /> approval of this proposed amendment to complete construction of a 4,000-square foot, <br /> • -1 <br />
