<br /> A RESOLUTION ACCEPTING THE DEDICATION OF LOT 2, HOKULI`A PHASE 3
<br /> EAST, PART B LARGE LOT SUBDIVISION, IDENTIFIED AS TMK NO. (3) 8-1-
<br /> 036:002, SITUATED ALONG THE SOUTHERLY SIDE OF HALEKI`I AND KE`EKE`E
<br /> 1ST, DISTRICT OF SOUTH KONA, ISLAND AND COUNTY OF HAWAII, STATE OF
<br /> HAWAII, FROM 1250 OCEANSIDE, LLC,A DELAWARE LIMITED LIABILITY
<br /> COMPANY.
<br /> WHEREAS, 1250 Oceanside, LLC, a Delaware limited liability company("1250
<br /> Oceanside"), is the owner of Lot 2, Hokuli`a Phase 3 East, Part B Large Lot Subdivision,
<br /> containing an area of 2.273 acres, identified as Tax Map Key(3) 8-1-036:002, situated along the
<br /> southerly side of Haleki i Street at Haleki i and Ke eke e 1st, District of South Kona, Island and
<br /> County of Hawai`i, State of Hawai`i,more particularly described in Exhibit A attached hereto
<br /> and as shown on the map attached hereto as Exhibit B ("Lot 2"); and
<br /> WHEREAS, Condition N of Ordinance 96-08 requires that 1250 Oceanside provide two
<br /> acres of land abutting the north side of Kona Scenic Park for public purposes prior to Final
<br /> Subdivision Approval of the subject property; and
<br /> WHEREAS, 1250 Oceanside is desirous of dedicating Lot 2, including all improvements
<br /> thereon, to the County of Hawai'i for park purposes; and
<br /> WHEREAS, Pursuant to Hawai`i County Code Section 2-162.1, the County of Hawai`i
<br /> Planning Department, Department of Public Works, Department of Parks and Recreation,
<br /> Department of Water Supply and the Department of Environmental Management have been
<br /> consulted, performed necessary inspections, and recommend approval and acceptance of this
<br /> dedication; and
<br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that
<br /> the council, on behalf of the county, may accept gifts of donations of money, securities, or other
<br /> personal property or of real estate or any interest in real estate; now therefore,
<br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that it
<br /> finds that it is in the public interest to accept this dedication of land as described herein.
<br /> BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF
<br /> HAWAII, in accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, and
<br /> Section 2-162.1 of the Hawai`i County Code, that the County of Hawai`i accept the dedication of
<br /> Lot 2, identified as Tax Map Key: (3) 8-1-036-002, delineated on Exhibit A and Exhibit B
<br /> attached hereto, including all improvements thereon, for public purposes.
