SUMMARY In summary, the Planning Director proceeded collaboratively in producing this Amendment Package. While the proposed amendments may not satisfy all parties (governmental or community), due to the temporal urgency and limited resources involved, the Planning Director has incorporated pertinent County institutional knowledge and community voices, by way of the Action Committee, into this process. The draft minutes from the May 14, 2019, KCDP Action Committee meeting have been provided as Exhibit B. Therefore, the Planning Director requests that the Leeward Planning Commission provide a favorable recommendation to the County Council to approve the Amendment Package provided in Exhibit A by ordinance to amend the KCDP previously adopted by Ordinance No. 08-131 and made effective September 25,2008. The draft ordinance to amend the KCDP is provided in Exhibit C. The reasons underlying the Amendment Package are that it is an intermediate action intended to better implement the KCDP, alleviate the Planning Department and related agencies from taking actions or having obligations that conflict with the HCC or Administrative Rules, and to protect the County from possible legal actions taken against the Planning Department similar in nature to the Missler Case.
