Supportive Information: The applicant has submitted the enclosed in support of the <br /> request: Planning Department Exhibit 1 - Change of Zone application, SMA Use <br /> Permit Application, and Final Environmental Assessment. <br /> 4. Hawaii Revised Statutes (HRS) Ch. 343: The applicant submitted a draft <br /> I <br /> Environmental Assessment (DEA) report on the proposed project for publication in the <br /> Office of Environmental Quality Control (OEQC) bulletin, the Environmental Notice, on <br /> May 8, 2019. The applicant received comments from agencies and the public during that <br /> i <br /> 30-day notice period. The Planning Director agreed with the projects Finding of No <br /> Significant Impact (FONSI) once the applicant integrated agency and public comments <br /> into a final EA (FEA). The FEA-FONSI was published in the August 8, 2019 edition of <br /> the OEQC Environmental ATotice. <br /> 5. Landowner: Kohala Shoreline, LLC <br /> i <br /> BACKGROUND INFORMATION AND HISTORY OF PROPERTY <br /> 6. Change of Zone Ordinance No. 97-102 (REZ 866): Approval to rezone the subject <br /> I <br /> I <br /> parcel (37.88-acres) from Agricultural 5-acre (A-5a) to a Single-Family Residential (RS- <br /> 15) zoning district, with an effective date of July 14, 1997. <br /> 7. SMA Permit No. 379: A SMA permit to allow for the development of a 50-lot single- <br /> family residential subdivision and related improvements on the subject parcel was <br /> approved by the Planning Commission with an effective date of July 14, 1997. 3 <br /> 8. Resolution No. 44-07: Resolved to temporarily delay Council action on rezoning <br /> I <br /> I <br /> applications in the District of North Kohala which permit transient lodging <br /> accommodations or which re-designate agricultural land into zoning districts with a <br /> minimum land area less than twenty (20) acres in size. <br /> 3 <br /> 9. Planning Director Initiated Change of Zone (REZ-'07-067): According to Condition C <br /> of Change of Zone Ordinance No. 97-102: "Final Subdivision Approval of the proposed <br /> 1 <br /> residential subdivision within the subject property shall be secured from the Planning <br /> Director within five (5) years from the effective date of this ordinance". Additionally, <br /> Condition No. 4 of. SMA permit No. 379 required that Final Subdivision Approval be <br /> secured within 5 years (i.e., July 14, 2002)from the effective date of the permit.
