Hawai`i County Charter Commission -10 April 25, 2019 <br />CHR. ADAMS: So that vote would be... <br />MS. RICE: That's the final vote? <br />CHR. ADAMS: That vote would actually... well, that would be the Final Vote <br />on the report that we are providing to the Council. <br />MS. RICE: Okay. Now, my question is, so it goes to Council, Council can either <br />accept what we send them or reject it. No, they can't reject it, they can send an <br />alternative, okay... so they send an alternative, then what happens to the <br />alternative? <br />CHR. ADAMS: Depending on what this Commission does... if the Commission <br />looks at the alternative that... and I am sure that I am actually going to get some <br />qualifying statements here, but if the alternative that the Council sends back <br />hypothetically is something that this Commission decides makes better sense then <br />what we initially had, then the Commission has the ability to incorporate that <br />alternative, that language into their proposal right? We would essentially change <br />whatever the proposal was that the alternative speaks to. <br />MS. RICE: So we can do that? <br />CHR. ADAMS: We can do that. If we don't do that, then... and, the Council <br />does not revoke its alternative, or recall it, doesn't recall its alternative which it <br />can do, so that the alternative stays, then the alternative is sent forward along with <br />our proposal to the Clerk when we send our final set of proposals. <br />MS. RICE: What does the recall mean? I don't quite follow that. <br />CHR. ADAMS: So the recall... in other words, the... according to HRS, the <br />Council has the ability to recall its alternatives. Meaning it can send us an <br />alternative but within a certain period of time it can say "actually we don't want <br />to do that", so that it would then not be sent on to the Clerk. In other words it <br />wouldn't be part of the ballot measure moving forward. <br />MS. RICE: But if we have accepted that... <br />CHR. ADAMS: If we accepted then that's fine. But they are... <br />MS. RICE: Then that's the end of it? <br />CHR. ADAMS: Then that's the end of that. <br />MS. RICE: Okay. Can the Council send us anything new? No? <br />Page 26 <br />
