I remember his protesting that he hadn't gotten <br />the response you know before the hearing ... but I don't recall any <br />clarification as to whether this ... that was a formal as opposed to an <br />informal hearing and I'm wondering whether it's ... would have <br />been possible for someone on the board to have asked for <br />clarification to give him a chance to say well I would like a formal <br />hearing. <br />Ms. Kahakalau: So I think that was... thank you very much ... that was sort of <br />indicated by J a little bit earlier you know that who's prerogative is <br />it to request the hearing you know ... is it that we have kind of <br />solicit that request or is it that the requestor knows ... I'm looking at those <br />minutes as an informal hearing ... the minutes reflect that that was <br />the initial hearing right and I'm reading through the minutes rights <br />so I mentioned the board can of course hear the initial statements <br />from the parties and can refer this for another hearing ... for an <br />informal hearing or it can schedule a formal hearing or it can do <br />other things such as dismiss the petition ... so the board if free to <br />ask questions with the petitioner... and we shall also hear from the <br />respondent as well so that hearing as far as what I recall and I see <br />in front of me ... that was the initial hearing right and then so <br />normal process is and I think Ku you've done this before when you <br />explained the process to the petitioner's at the beginning as you tell <br />22 <br />
