pre -conference stuff I think we could do well to get together and <br />discuss this you know and find out what the best course of action <br />would be ... and we met ... and we discussed it ... now the two issues <br />themselves... the discovery issue I feel falls upon J ... perhaps <br />rightly or wrongly ... J would probably offer your guys opinion on <br />the subject and I might ask to cross-examine ... but the denial of <br />cross-examination falls on the commission... now with no known <br />procedure for complaining for filing a complaint against the ethics <br />commission I don't know how many of you would have to recuse <br />yourself from a complaint... and I don't know if you would have a <br />quorum left over when it was done ... when the recusals were <br />complete ... so I... contacted J and said well you know J perhaps <br />we could consider mediation as a way to solve this ... and I never <br />got a firm response from J back about moving forward or a way <br />from mediation as a subject ... what I got was ... we'd like to invite <br />you to a hearing on January 9 for discussion... it was that simply <br />explained.... <br />Mr. Goodenow: Yes. <br />Ms. Kahakalau: Yes ... thank you very much we appreciate that ... Mr. Goodenow ... I <br />have.. . <br />Mr. Goodenow: For discussion I do have a question for you ... first I would like to <br />thank you for coming forward ... it's good timing with us looking at <br />the rules and procedures so I do appreciate that ... you know I <br />should know the answer to this but I'm sorry to say I don't <br />but ... when you fill out the actual petition ... and you submitted ... do <br />you get any kind of letter back from ... saying that oh we've <br />received your petition and here are some of the guidelines of the <br />Board of Ethics? <br />Mr. Tucker: I recall that I did. <br />Mr. Goodenow: I don't know if there was anything in there about an informal <br />verses a formal hearing ... a formal hearing which has to comply <br />with all of the statutory procedural requirements and the <br />requirements in our rules... right... that's what would get say <br />appealed or ... but the informal hearings quite different I don't <br />know if you had any ... what I'm ... understanding of that ... you <br />know what notice did you have regarding your right to a formal <br />hearing ... after the informal hearing you can say hey I don't like <br />7 <br />
