what you did ... I want a formal hearing... meaning <br />witnesses... courtroom type procedures... but I'm not sure ... if you <br />understood... you know what kind of notice you got about that or <br />did you consider asking for a formal hearing? Or you just didn't <br />know to do that ... or that's what I'm curious about... <br />Mr. Tucker: I understood it to be ... I understood it to be a formal hearing and <br />that there are transcripts kept and the hearing was filmed and is on <br />YouTube or somewhere up online to be viewed if you <br />want ... but ... I was not ... it was not my desire ... not too long after <br />the dismissal of my cases ... to appeal ... and it was not my desire <br />here now to reargue these two 2016 complaints. <br />Ms. Kahakalau: Okay ... I also want to echo you know thank you for ... bringing it <br />up so that we can talk about it because we do take our task very <br />seriously here and if there are things that we can improve and if we <br />can make... communication more transparent and if we can meet <br />the needs of the people that come to us in a better way that we're <br />currently doing that ... you know we're definitely open in terms of <br />amending the code etc .... so maybe I'd like to start with ... kind of <br />dissecting a little bit and just starting with the "a" part to me which <br />is a discovery piece and just for ... J to go over the procedure and <br />we do have it in our minutes but because not everybody is familiar <br />with it I think it would be a good thing for us all to know <br />anyway... <br />Mr. Goodenow: Yes. <br />Ms. Kahakalau: What the specific procedure is in terms of the discovery aspect. <br />Mr. Yoshimoto: Okay ... thank you Madame Chair so I'll point the members and <br />Mr. Tucker to board rule 4.13 (Confidentiality) and I'll read that <br />into the record... subsection a states...."All records, reports, <br />documents, exhibits, and other evidence received by the board <br />shall be held in confidence, and no information as to the contents <br />thereof shall be disclosed unless such items are presented and <br />received by the board at a hearing or meeting that is open to the <br />public." So as I recall ... I think I explained this at hearing that we <br />had during the first petition because Mr. Tucker did raise you <br />know the same concerns back then as he did today and I explained <br />in that—the records need to be confidential and that's why the <br />board received those records into evidence to properly consider <br />0 <br />
