Mr. Goodenow: <br />Alright we'll vote on this one then we can move to the other topic. <br />Good suggestion. Okay. The motion again is that there was a <br />violation of Charter, section 14-3, as stated in the Charter. No <br />further discussion? Seeing none...all in favor say aye. Any <br />opposed? Motion carries five to zero. <br />Motion and Vote: Mr. Robinson moved to issue an informal advisory opinion. Ms. <br />Sumner -Mack seconded the motion. All members voted aye. <br />Mr. Goodenow: As far as the other issue now regarding... Any other motions or <br />shall we consider this matter over? <br />Mr. Heintz: <br />Mr. Wiseman: <br />Mr. Chair, I'm not ready to make another motion but the <br />petitioners have raised at least five different issues in my mind. <br />Including...was it appropriate...or is it appropriate in the future <br />of...for a Councilmember and just using this case...to introduce a <br />bill...like Bill 16... in case of a representative or Councilmember <br />Kierkiewicz. I want to say that on that particular point, it seems <br />that Councilmember Kierkiewicz was following procedure and so I <br />see no problem with the fact that she introduced the Bill. That was <br />part of her role. But then there's the question of whether or not she <br />should recuse herself or not. And then there's a further two <br />questions...I think in Ms. Hardens petition in particular about <br />the...they're asking that beyond this particular case...that more <br />general advice and discussion and recommendation by the Ethics <br />Committee to the Council as a whole on these questions of <br />disclosure and voting on issues where there's our need for recusal. <br />I think such a general policy statement or letter would require us to <br />do some work. I'm not prepared to make a motion. But I just <br />want to point out that I think there are at least four other issues that <br />we have not addressed. <br />Yes. I would concur with Larry with respect to...to that issue. I'm <br />concerned with perhaps in a suggested language that we could <br />include and it would just be a suggestion...what they call...the <br />legal opinion which would be to the effect that the <br />Councilmembers should or the chair should refresh themselves on <br />the Charter provision. As we know...you go into these <br />meetings...no one has the Charter in front of them. You know it's <br />not...intentional avoidance...it's just not there to preoccupy with <br />other important issues. So perhaps it will be fresher on this code <br />section part of...the Charter section that we mentioned. <br />Mr. Goodenow: Alright. Further discussion? I would move. Alright we don't <br />have to move I think it's included in the fact that we're drafting an <br />32 <br />
