I think we could put in the opinion that we you know <br />send the copy of the opinion to the Council chair and... <br />Well maybe all the Council members. <br />Or Councilmembers. And maybe we could include language <br />stating that you know...we did not look at...not pass judgement... <br />Rule 11 is a Council rule, that's their internal procedure. However, <br />we note that of course, any rule of the Council would have to be <br />compliant with the County Charter which provides... And again <br />we're going now to the other section now, right? Conflict of <br />interest. Are we gonna make a ruling on conflict of interest. <br />Section 14-2 standard says it shall constitute a conflict of interest <br />for employees or officers of the County to and then it...there's (b) <br />use their official position to secure special privileges, <br />consideration, treatment or exemption to themselves or any <br />persons beyond that which is available to every other person. I <br />don't think that applies. Someone might think it does but in my <br />opinion, no. But then there's (c) engage in any business, <br />transaction or activity or have a financial interest, direct or indirect, <br />which might reasonably tend to be incompatible with the proper <br />discharge of their official duties or to impair their independence of <br />judgment in the performance of their official duties. I'm not...I <br />don't feel we need to make a ruling or findings that this is what <br />happened. But maybe we could as Mr. Wiseman suggests, include <br />that that maybe we don't have a finding but we note... I mean the <br />issue is she divested herself, right, she's resigned. So it doesn't <br />exist anymore. Would the Charter still allow her to vote? And do <br />we wanna go there or should we leave that for the Council to <br />decide. <br />I don't think we ought to go there. I think we should leave that to <br />the Council to decide. In other words we're asking the County <br />Council to abide by some rules. I think that's fine. <br />And the petitioners... Okay. Any other discussion? So we won't <br />really make another motion then. We'll just leave it with the <br />disclosure. <br />And to be clear then so in the informal advisory opinion, you want <br />to state that there's... <br />We're not gonna go into this.
