<br /> <br />§3-37 Permanent appointment. <br /> <br />A permanent appointment is granted an employee under either one of <br />the following conditions: <br /> <br />(a) After satisfactorily completing a probation period in an <br />appointment without a limitation date in a permanent position. <br /> <br />(b) When specifically authorized by statute. <br />\[Eff. 07-01-02; am 03-01-15\] (Auth: HRS §76-17) (Imp: HRS §76-13) <br /> <br />§3-38 Probationary appointment. <br /> <br />(a) All civil service appointments which are at least the duration of the <br />initial probation period shall be filled by probationary appointment, <br />except as provided by these rules. <br /> <br />(b) Initial probation period. Initial probation period shall be utilized as <br />part of the examination process to determine the employee’s <br />fitness and ability for employment in the position and the civil <br />service. <br /> <br />(1) An employee must meet the performance requirements of <br />the position as measured by a formal performance appraisal <br />in order to successfully complete the initial probation period; <br /> <br />(2) Initial probation period shall be for a period of six months <br />provided the director may establish an initial probation <br />period of one year for certain classes of work when a longer <br />period is needed to adequately train and evaluate the <br />employee; <br /> <br />(3) The appointing authority may extend the probation period <br />upon written notification to the employee and the director <br />prior to the expiration of the probation period. Failure to <br />inform the employee in writing prior to the expiration date <br />shall result in the employee being granted a permanent <br />appointment by default. The appointing authority may <br />extend the initial probation period for any of the following <br />reasons: <br /> <br />(A) The employee's absence affects the appointing <br />authority's ability to evaluate the employee's <br />performance, provided the extension shall not <br />exceed the period of absence or combined periods <br />of absences; <br /> <br />3-21 <br /> <br />
