HALVORSON: And James Halvorson, Deputy <br />3 <br />Attorney, advisor to the Merit Appeals Board. <br />4 <br />CHAIR TULANG: Our court secretary. <br />5 <br />And I'm sorry to say that another Board <br />6 <br />member, David Nahuina, was unable to join us today, <br />7 <br />so -- however, we have a quorum. <br />8 <br />Both counsels are present and will be making <br />9 <br />introductions to the proceedings as we go on. <br />10 <br />So, this hearing is on the appeal of <br />11 <br />Ms. Doreen "Dee" Torres. The issue in this case has <br />12 <br />been identified as that the Employer, the County of <br />13 <br />Hawai ʻ i, Clerk of the County of Hawai ʻ i, did violate any <br />14 <br />statutes, regulations, rules, or personnel policies <br />15 <br />when appellant's Step 2 decision was denied concerning <br />16 <br />alleged policy violations? If the answer to the above <br />17 <br />is “yes,” then what remedy can be awarded by the Merit <br />18 <br />Appeals Board? <br />19 <br />The Board has received a communication by the <br />20 <br />respondent County to discuss the motion for lack of <br />21 <br />jurisdiction. We will take up this matter first, and <br />22 <br />the Board will now hear oral arguments; but before I <br />23 <br />say that, let me acknowledge that we are in receipt of <br />24 <br />two documents, the Board members, which was given to us <br />25 <br />this morning, one from the County of Hawai ʻ i and the <br /> <br />ISLAND COURT REPORTING & TRANSCRIPTION SERVICES <br />(808) 933-9800 <br /> <br />
