<br /> <br />Page 14 <br />1 <br />provided to us, and at that point in time when we <br />2 <br />looked -- or I looked at the facts of the case -- and <br />3 <br />I -- and I grant you that when Ms. Torres did file the <br />4 <br />appeal, it was the wrong box to have checked; but my <br />5 <br />hope is that you want to look at this because I think <br />6 <br />there's some serious violations of the merit principle <br />7 <br />when you look in totality of what's happened to <br />8 <br />Ms. Torres. It goes back to the fact that she's a <br />9 <br />Council Services Assistant 1 and has been since 2003. <br />10 <br />That's a long time to be at the clerical level in a <br />11 <br />class where there is progression to the 2 and to the 3. <br />12 <br />And normally what we see is that when a <br />13 <br />person does not progress, there's something wrong with <br />14 <br />their performance. We see this time and again. The <br />15 <br />employer says, "Hey, you know what? You just don't <br />16 <br />have what it takes to move on." We see it in the <br />17 <br />performance evaluations. We see it in notices to <br />18 <br />improve. We didn't see that in Ms. Torres' case, and <br />19 <br />that caused us concern. <br />20 <br />Now, we asked why she didn't file back in <br />21 <br />2014 when she first was denied a promotion to the CSA2. <br />22 <br />Now, if you look at the CSA1 class specs. versus the 2 <br />23 <br />class specs., the difference is one year of additional <br />24 <br />general clerical experience.
