For the record, <br />3 <br />this hearing is an appeal filed by Ms. Myrlene Kaloi. <br />4 <br />The issue in this case has been identified as did the <br />5 <br />Employer, the Department of Human Resources of the <br />6 <br />County of Hawai ʻ i, violate any statutes, regulations, <br />7 <br />use, or personnel policies regarding the <br />8 <br />reclassification of a particular position action <br />9 <br />concerning a request by the Appellant for an audit of <br />10 <br />positions at the Mass Transit Agency and compensation <br />11 <br />for work performed? <br />12 <br />So, what we will do is the Board is in receipt <br />13 <br />of all the communications to discuss this motion for <br />14 <br />lack of jurisdiction from the County. We will take up <br />15 <br />this matter first, and the Board will now hear oral <br />16 <br />arguments of that motion. And we will start with the <br />17 <br />County of Hawai ʻ i. <br />18 <br />MR. KAGAMI: Good morning. Basically, our <br />19 <br />position is that Hawai ʻ i Revised Statutes, as well as <br />20 <br />the Merit Appeal Board rules, require that the internal <br />21 <br />complaint procedure be exhausted before the Merit <br />22 <br />Appeals Board gets involved. That wasn't done here, so <br />23 <br />that's why we're seeking a dismissal for failure to <br />24 <br />exhaust those remedies. <br />25 <br />CHAIR TULANG: Okay.
