There was an action by the <br />5 <br />person -- not a disciplinary action, not a performance <br />6 <br />evaluation action. This was an action of selection by <br />7 <br />the County and, in this case, that is your jurisdiction <br />8 <br />regardless of whether they're civil service employees, <br />9 <br />bargaining unit members, or members of the public. <br />10 <br />That is your purview. So, to make the argument that <br />11 <br />because they're civil service employees and because we <br />12 <br />have a promotions article, that's their avenue for <br />13 <br />relief -- that is not true. I can tell you we filed <br />14 <br />hundreds of promotions articles, and that comes up over <br />15 <br />and over again. Recruitment exam -- that is civil <br />16 <br />service. That is the Merit Principle. So, I think to <br />17 <br />turn it around now and to say that this is properly in <br />18 <br />the grievance process -- no, we don't agree. <br />19 <br />MR. MUKAI: If I may briefly respond.
