MUKAI: With regard to this specific <br />8 <br />appeal under 76-14, when Mr. Keopuhiwa talks about <br />9 <br />other employment actions under 76-14, the statute is <br />10 <br />clear that it must be -- the Appellant must be a civil <br />11 <br />service employee excluded from collective bargaining; <br />12 <br />so the statute by its very terms is clear. <br />13 <br />And I've also submitted in my reply to the <br />14 <br />Merit Appeals Board that this placement action that <br />15 <br />took place initially that gives rise to all of this is, <br />16 <br />in fact -- continues to be pursued in the BU-11 <br />17 <br />contract under the grievance procedure. <br />18 <br />MR.
