CARR SMITH: I have some frustration with the process only because we have to decide on this <br /> contested case standing before we can make a decision on the case, and it makes it challenging <br /> because—I'm not saying I'm for it or against it—but we could possibly easily decide on whether <br /> we wanted to deal with the case or not, and with the contested case, it just makes it a whole <br /> different experience and level of energy for everybody involved. That's my comment. <br /> UNGER: I'll support the motion, but it was difficult because of just the procedure that we have <br /> to follow, and, so, while I support West Hawaii Surfing Association and I agree that they have <br /> some very passionate cares along this, along this area, everybody that testified here today for the <br /> most part that were not members of the West Hawaii Surfing] Association also had passionate <br /> concerns. And, so my—you know, I do question whether West Hawaii Surfing Association has <br /> an interest, as passionate as it is, any different than any of the other members of the public who <br /> also are concerned about this process; however, as Commissioner Vitousek stated, Mr. Alapai's <br /> connection to the land historically does tilt it to, for me, to back this motion. <br /> Hearing no other comments from Commissioners, hea inoa, roll call. <br /> JACKSON: Commissioner Vitousek? <br /> VITOUSEK: Aye. <br /> JACKSON: Commissioner Kealoha? <br /> KEALOHA: Aye. <br /> JACKSON: Commissioner Carr Smith? <br /> CARR SMITH: Aye. <br /> JACKSON: Commissioner Yates? <br /> YATES: Aye. <br /> JACKSON: And Chair Unger. <br /> UNGER: Aye. <br /> JACKSON: The motion to grant standing carries, five-zero. <br /> UNGER: Thank you. To the petitioners and the applicant, you'll be notified in writing of the <br /> Commission's decision. Our next process is to hear from the Commissioners in regard to how <br /> we will be conducting the contested case hearing. Our choices are to make a motion to hire a <br /> hearing officer outside of the Commission to hear the contested case hearing; or the Commission <br /> may hear it; or a member of the Commission may hear it.
