And if anybody has <br /> any question about that... When I testified about that at the <br /> County Council hearing... <br /> Mr. Robinson: Time <br /> Mr. Canda: What they were doing. If there was a safety <br /> issue on Mauna Kea and his response was...yes, look at all the <br /> citations we have. What's central to this is issue is that...in the <br /> recent hearing for Chairman Aila...they determined that it's an <br /> illegal structure. The Mauna Kea access road. They've never paid <br /> for it, they stole it. That's the problem. And it's not the <br /> jurisdiction of the County. The police are allowed to go on there <br /> through the MOA...to assist with emergencies. But it's not their <br /> jurisdiction. So they have been trying to clear that road. They 38 <br /> arrests to prove it. They have 8,300 citations. They allow the <br /> DUA fatality rate to rise by 80% while neglecting general safety of <br /> the public. Running fake road blocks up there. Screening people <br /> to check their papers and asking them, not if they were drinking, <br /> but are you going to the Mauna. And then pulling them over and <br /> writing tickets. Okay so, this is not that they were dereliction of <br /> duty. It's whether... It's a performance of duty issue if you wanna <br /> look at it that way. Cause they have been trying to clear the road. <br /> They spent four months writing 8,300 tickets to prepare the <br /> grounds for a clearing. To debilitate and to trick the people that <br /> are up there. So they have been trying to clear the road. That's <br /> part of the strategy. So it's whether...if they're being competent of <br /> that... I've had to do discipline for County officers before. Over <br /> dereliction of duty type things and there is no...there's nothing in <br /> the County on performance of duty. <br /> Mr. Wiseman: Is it your contention that the access road is State jurisdiction or a <br /> County. <br /> Mr. Canda: It's not a... It is the County...or the State. That's why we have an <br /> MOA. We have an MOA. <br /> Mr. Wiseman: Also, could you tell me the status of the complaint you filed?
