DPW/LRB <br /> CONSTRUCTION CODE - DRAFT 5/26/20 <br /> For review and comment <br /> (j) The authority having jurisdiction may require plans, computations, and specifications to be <br /> prepared, designed, and stamped by a person who is licensed in the State of Hawaii as an <br /> architect or professional engineer, if prescriptive requirements of the construction code are <br /> not being adhered to. {5-25(h).) <br /> (k) No person shall materially deviate from any reviewed plan or specifications or fail, neglect <br /> or refuse to comply herewith, unless permission to do so has first been obtained from the <br /> person who is licensed in the State of Hawaii and listed as the architect or professional <br /> engineer of record. Revised drawings or a letter, or both, that show such deviations and <br /> have have been prepared, designed, and stamped by the architect or professional engineer <br /> of record, shall be submitted to the authority having jurisdiction for review and approval. <br /> {9-33(c).) <br /> Section 5-4-4. Review of application. <br /> (a) The application,plans, specifications, and other data filed by an applicant for a permit shall <br /> be reviewed by the authority having jurisdiction. Plans shall also be reviewed by other <br /> appropriate departments and divisions of the County and the State to verify compliance <br /> with laws under their jurisdiction. {5-28(a), 9-34, 17-18(c).) <br /> (b) Nothing contained in the construction code shall be construed to require the authority <br /> having jurisdiction to accept or reject any permit application before completion of reviews <br /> required pursuant to the construction code and other applicable laws. {9-32.) <br /> Section 5-4-5. Action on application. <br /> (a) If the application,plans, specifications, and other data filed by an applicant for a permit do <br /> not conform to the requirements of pertinent laws, the authority having jurisdiction shall <br /> reject such application in writing, stating the reasons therefor. {105.3.1 MCC.) <br /> (b) If the authority having jurisdiction finds that the work described in an application for a <br /> permit and the plans, specifications and other data filed therewith conform to the <br /> requirements of the construction code and all other pertinent laws; and the fees specified in <br /> article 7 have been paid, the authority having jurisdiction shall issue a permit therefore to <br /> the applicant. {5-28(a), 9-34, 17-18(c).) <br /> Section 5-4-6. Cancellation of application. <br /> (a) Thirty days to pick up permit or plan review letter. <br /> Upon notice to applicant that their application is ready for pick up with either a <br /> "recommend for issuance" or"recommend return with correction,"the applicant shall have <br /> thirty working days to pick up their permit or application respectively. If the permit <br /> application is not picked up within thirty working days, the application will be cancelled. <br /> The thirty-day period will begin on the working day following the day that notification is <br /> electronically sent to the applicant. <br /> 22 <br />
