3H Valued Cultural Resources <br /> In view of the recent Hawaii State Supreme Courts "PASH" and <br /> "Ka Pa'akai 0 Ka'Aina"decisions, the issue relative to native <br /> Hawaiian gathering and fishing rights must be addressed. <br /> Specifically, there must be a discussion of the cultural, historical, <br /> and natural resources and associated traditional and customary <br /> practices of this site. <br /> In this situation, the subject site is not adjacent and/or proximate to <br /> the shoreline. As such, fishing and/or coastal access is not an <br /> issue. <br /> It is not known whether the subject property or immediate <br /> surrounding area have ever been used for the gathering of plants <br /> by native Hawaiians. However, it would appear very unlikely that <br /> the site would serve such purpose today and/or in the recent past. <br /> There are also no known archaeological features on the subject <br /> property. <br /> Based on the above, it does not appear that the project would have <br /> any potential adverse impact relating to the cultural and historical <br /> resources of this area. <br /> 31 PUBLIC ACCESS <br /> The subject parcel is located approximately 4.5-miles from the <br /> shoreline. As such, no public access will be affected by this <br /> request. <br /> 3J DESCRIPTION OF ACCESS <br /> The subject parcel is accessed via Ainalako Road. Ainalako Road <br /> is a County owned and maintained road with a 50-foot right of way <br /> and average pavement width of 20-feet. Vehicles will have a clear <br /> ingress and egress into the proposed parking stalls from Ainalako <br /> Road. Based on the existing conditions of Ainalako Road, it <br /> appears no roadway improvements would be required for the <br /> proposed use. <br /> Consultation with the Department of Public Works Engineering <br /> Division has indicated that a 5-foot future roadway widening <br /> setback should apply to the subject property based on the "City of <br /> Hilo Road Alignments, Right of Way and Zoning Map". The 5-foot <br /> planned future widening is indicated on the Conceptual Site Plan <br /> 9 <br />
