Mr. Wiseman: It would be executive session. I'm preferring in executive session <br />to deliberate and come out with decision. <br />Mr. Mural: Not to split hairs, but the Board may exercise it's adjudicatory <br />functions in a closed session. But executive session is a kind of a <br />term of art that has very specific reasons for going into executive, <br />one of which is to consult with the counsel. <br />Mr. Wiseman: Right. <br />Mr. Murai: To do things like evaluate the performance of employees... That <br />sort of thing. I don't mean to split hairs with you but we could <br />close the meeting for deliberation. This should be different than an <br />executive session. All the... <br />Mr. Wiseman: Well whichever way you perceive is fine with me. <br />Mr. Murai: Functionally, they're the same. <br />Mr. Wiseman: So are we going to... Do we want to do that now in a closed <br />session? <br />Ms. Aiello: Pardon me, this is Jeanette, I'm helping the Board of Ethics with <br />the technical things about the meeting. My recommendation to <br />be ... would be ... if we're going into an additional executive session <br />that we hadn't planned for, kinda table this matter and take it up <br />during the executive session that's already been placed on the <br />agenda with the other items. And then take the vote after that <br />executive session is pau. <br />Mr. Murai: Mr. Chair. I think that's a good suggestion. <br />Mr. Wiseman: Yes, I agree. So let's do that. Okay, this matter will be tabled and <br />we'll address during the executive session. <br />Mr. Murai: Okay so I'll step aside and you can turn the gavel back over to <br />Chair. <br />Mr. Wiseman: Rick, Mr. Chairman.
