public roadway within a 60-foot wide right-of-way and constructed in conjunction <br /> with any of the project's development requiring access from said road. <br /> The Planning Director agrees with the applicant's amendments with <br /> modifications, to state the road shall be constructed meeting DPW requirements <br /> and be dedicated to the County upon request and no cost to the County. <br /> In addition to the applicant's above requested amendments,deletion <br /> and addition to conditions,the Planning Director recommends deletions, <br /> additions, and amendments of other existing conditions in the ordinance,to <br /> include but not be limited to the following conditions, to reflect the current <br /> standard language for conditions of approval and to reflect conditions the <br /> applicant has already complied with. <br /> New Condition C is added to include a standard definition for `occupancy' <br /> throughout the ordinance. Several conditions of the ordinance refence occupancy <br /> as the trigger or deadline for providing road and park improvements. The <br /> Planning Director recommends adding this condition, which uses the definition of <br /> `occupancy' from the Concurrency Standards section of the Zoning Code. In this <br /> definition there are three types of occupancy triggers for various land uses. The <br /> first is at final subdivision approval by the Planning Department when single- <br /> family residential lots are created but homes are not yet built before the lots are <br /> sold. The second is at issuance of a Certificate of Occupancy by DPW for <br /> commercial, industrial,hotel and multi-family residential units. The third is at <br /> issuance of a building permit for residential buildings that do not require a <br /> Certificate of Occupancy(typically single-family dwellings). <br /> Condition D (former Condition C) is amended to indicate a revised Water <br /> Master Plan is required for the new phasing plan and updates the condition with <br /> the most current Water Agreement on file, which is in the process of being <br /> amended. These amendments were recommended by the Department of Water <br /> Supply in their memo dated September 21, 2020. <br /> -25- <br />
