ANDREWS: Yeah, so, again, I don't, I don't know the history of that office building that is not <br /> part of this project site. <br /> VAN PERNIS: The applicant has, or the applicant's predecessor from whom it purchased, built <br /> certain improvements on the property, including a parking garage, right? <br /> ANDREWS: Sorry I didn't understand that question. Could you repeat it? <br /> VAN PERNIS: The applicant, be it Diamond or its predecessor seller Monarch, built certain <br /> improvements on the property, right? <br /> ANDREWS: On the subject— <br /> VAN <br /> ubjectVAN PERNIS: Yes, on the subject property. <br /> ANDREWS: Yes, there has been, there has been work done over the course of the past years. <br /> That's correct. <br /> VAN PERNIS: Do you know when that work was done? <br /> ANDREWS: If you look in the background, there are some—let's see, it would be the parking <br /> garage that you are talking about. I believe that was done in about 2008 and 2009, but the <br /> applicant could probably address that, more specific dates to the exact date. There were building <br /> permits pulled for that work. <br /> VAN PERNIS: As per the original approval, weren't the applicants required to improve the <br /> roadside with sidewalks and gutters, and improve—on Alii Drive—and improve Kahakai Road? <br /> ANDREWS: Well, we can look to you are asking me about the original conditions. <br /> VAN PERNIS: Yes. <br /> CARR SMITH: Item number 4, the Condition number 4 addresses that. <br /> ANDREWS: Yeah, on the original permit, that was Condition number 6 there, "Ah'i Drive and <br /> Kahakai Road shall be improved along the property's frontage with curb, gutter, and sidewalk <br /> construction, pavement widening, drainage improvements, and relocation of utilities along the <br /> Alii Drive and Kahakai Road frontages meeting with the approval of the Department of Public <br /> Works " <br /> VAN PERNIS: So they built a parking garage but not those improvements for the public. Is that <br /> right? <br /> ANDREWS: That's what has happened so far, Commissioner. <br /> 4 <br /> EXHIBIT E <br />
