Smith: Do the Board Members have any questions of the Department? <br />There were no questions from the Board Members. <br />Smith: Hearing none, Ms. Schoen, please provide the Department recommendation for <br />penalty in this case. <br />Schoen: The license was originally issued November 15, 2011. They have no past violations <br />for the last five years. The Department is recommending a $2,000 fine with $1,000 suspended <br />for one year from the date of service of the Decision and Order, on the condition that there <br />is no similar violation, and that $1,000 be paid within thirty (30) days upon receipt of the <br />Decision and Order, and that it be made payable to the Department of Liquor Control. In this <br />case the Licensee did take responsibility. Their employees were immediately retrained on the <br />liquor laws. As a result, the Seven -Eleven corporate store did order all of their Hawaii stores <br />to no longer accept the vertical IDs as alcohol and tobacco licenses (proof of age). So, they <br />have taken a lot of measures to relegate the issue. They have informed the employees that <br />reading the date incorrectly on an ID is not an excuse. <br />Schoen: The Department's recommendation for this case is a $2,000 fine, with $1,000 <br />suspended for one year from the date of service of the Decision and Order, on the condition <br />that there be no similar violations and that $1,000 be paid within thirty (30) days from the date <br />of service of the Decision and Order, and that it be made payable to the Department of Liquor <br />Control. Do I have a motion to impose the penalty? <br />Mukai: I move to accept the recommendation of the Department. <br />Smith: Is there a second? <br />Taniguchi: Second. <br />Mr. Mukai moved that the Licensee in Case No. 2020-009, <br />be assessed a penalty in the amount of $2,000 with $1,000 <br />suspended for one year from the date of service of the <br />Decision and Order, on the condition that there be no similar <br />violation of Section 281-78(b)(1)(A) of the Hawaii Revised <br />Statutes, as amended, Sale to a Minor, and that $1,000 <br />is to be paid within thirty (30) days upon receipt of the <br />Decision and Order, made payable to the Department <br />of Liquor Control; seconded by Mr. Taniguchi. <br />Smith: Thank you very much, Art.
