§ 2-23 H AWAI‘I C OUNTY C ODE <br />Section 2-23. Benefits. <br />All persons who are members of the volunteer fire department while engaged in the <br />training and performance of volunteer fire fighting shall be entitled to benefits as <br />provided by this article. <br />(1983 CC, c 2, art 6, sec 2-23.)2-23 <br />Section 2-24. Extent of coverage. <br />In case of injury or death arising out of and in the performance of volunteer fire <br />fighting or training, all persons included in section 2-23, shall be entitled to benefits as <br />prescribed by chapter 386, Hawai‘i Revised Statutes. No person shall be excluded from <br />receiving such benefits by reason of being an elected official, employer, or having an <br />occupation which is excluded from coverage under chapter 386. <br />(1983 CC, c 2, art 6, sec 2-24.)2-24 <br />Section 2-25. Computation of wages. <br />For the purposes of the benefits under this article, average weekly wages or <br />earnings shall be computed from the usual employment or occupation of the person <br />upon the basis set forth in section 386-51, Hawai‘i Revised Statutes, or upon the basis of <br />earnings at the rate of $20 per week, whichever is most favorable to the claimant. <br />(1983 CC, c 2, art 6, sec 2-25.)2-25 <br />Section 2-26. Volunteers not members of volunteer fire department. <br />(a) All persons not members of the volunteer fire department who volunteer their <br />services at fires and whose services are accepted by authorized persons and whose <br />injuries or death arise out of and in the performance of volunteer fire fighting shall <br />be paid their reasonable hospital and medical expenses as authorized by section <br />386-171, Hawai‘i Revised Statutes, and funeral expenses not to exceed $300. <br />(b) “Authorized persons” as used in this section means such persons in the County fire <br />department or volunteer fire department who are supervising or directing the fire- <br />fighting operations. <br />(1983 CC, c 2, art 6, sec 2-26.)2-26 <br />Article 7. Windward and leeward planning commissions. <br />(a) There shall be a windward planning commission and a leeward planning <br />commission, each made up of seven members as provided for by Charter. The <br />windward and leeward planning commissions shall: <br />(1) Perform such duties as are prescribed by the Charter. <br />(2) Perform such other duties as are assigned to it by state law or this Code. <br />2-12 <br /> <br />
