§ 14-34 H AWAI‘I C OUNTY C ODE
<br />Section 14-34. Violation and penalty.
<br />(a) Any person, corporation, public agency or other entity who violates this article shall
<br />be fined not more than $1,000 per incident.
<br />(b) Money from fines collected for violation of this article shall be deposited into the
<br />general fund and utilized by the department of parks and recreation for mineral
<br />sunscreen dispensers, educational materials, and related purposes.
<br />(c) In addition to the foregoing, any designee of the department of environmental
<br />management shall seize and dispose of any product in violation of this article.

<br />Section 14-35. No conflict with State or Federal law.
<br />Nothing in this article may be interpreted or applied so as to create any
<br />requirement or duty in conflict with any State or Federal law.

<br />Article 6. Property Offenses.
<br />Section 14-39. Duty of chief of police; cultivated grounds.
<br />It shall be the duty of the chief of police to protect lawns, gardens, grass plots, and
<br />other cultivated grounds belonging to the State and the County within the County, and
<br />all lawns, gardens, grass plots, and other cultivated grounds of a public nature within
<br />the County, and to place or cause to be placed on these places signs and notices warning
<br />persons to keep off these places; provided that this section shall not apply, during the
<br />period from February 1 through October 31 of each year, to the Hilo bayfront area,
<br />situated makai of the Hawai‘i Belt Road, from the intersection of Kamehameha Avenue
<br />and Hawai‘i Belt Road as delineated in the attached map.*

<br />Section 14-40. Trespass prohibited; penalty.
<br />(a) A person who trespasses or walks on or over a lawn, garden, grass plot or other
<br />cultivated ground, on which there is a sign or notice to keep off shall be guilty of a
<br />misdemeanor. Upon conviction, the person convicted shall be fined not less than
<br />$2.50 nor more than $25, in the discretion of the judge having jurisdiction of the
<br />case.

<br />Section 14-40.1. Property damage prohibited; penalty.
<br />(a) It shall be unlawful for any person maliciously or wilfully to mar, injure, damage,
<br />destroy, or deface or aid in marring, injuring, damaging, destroying, or defacing any
<br />public building, sign, sidewalk, light pole, wall fixture, playground, structure,
<br />facility, or other property of the County without its consent.
