§ 25-1-5 H AWAI‘I C OUNTY C ODE <br />“Frontage” means that portion of a building site which abuts a road, street, or <br />highway. <br />“Fuel cell electric vehicle” means a zero-emission electric vehicle that uses a fuel <br />cell to convert hydrogen gas and oxygen into electricity that is used in a vehicle <br />powertrain for propulsion. <br />“Funeral home” or “funeral parlor” means a business establishment where the <br />bodies of the dead are prepared for burial or cremation and religious or memorial <br />services can be held. <br />“Funeral services” means an assortment of services provided by mortuaries, <br />crematoriums, and funeral homes that may provide for: the sale of pre-death final <br />expenses insurance, sale of caskets or closed containers for cremains, coordination for <br />burials of caskets and cremains, embalming, viewings, storage and transportation of the <br />decedent or cremains, funeral planning, religious or memorial services, and completion <br />of death certificates and other legal documents. <br />“Future width lines” means lines established on the zoning map, for purposes of <br />future widening of an existing street and establishing the front property line of an <br />affected building site. The area within these lines or between a future width line and an <br />existing street right-of-way line, shall be deemed to be a street right-of-way, and cannot <br />be considered in computing the minimum yard required on any building site. <br />“Group living facility” means a 24-hour residential facility licensed or certified, and <br />monitored by the State of Hawai‘i’s Department of Health (DOH) or Department of <br />Human Services (DHS), for persons covered under the Fair Housing Act, as amended, <br />containing between six and eight unrelated adults and/or children, plus unrelated home <br />operator or staff who shall not be included in the resident count. <br />(a) The purpose of this definition is to provide housing to protected and targeted <br />populations that require therapeutic, medicinal, life skills training, or other <br />support systems. These facilities shall be integrated into a variety of <br />neighborhoods while maintaining the integrity and character of the <br />neighborhood(s), to promote a non-institutional environment and provide the <br />maximum therapeutic and beneficial value to residents of a group living <br />facility. <br />(b) Unless a use permit or special permit is obtained: <br />(1) A group living facility shall have no more than eight residents; <br />(2) Only one group living facility per tax map key parcel; <br />(3) No other such licensed or certified dwelling shall be located within 500 <br />feet of the perimeter of any tax map key parcel containing any other <br />group living facility, with the exception of an adult residential care home <br />or an intermediate care facility/mental retardation community <br />(ICF/MR-C). <br />(c) A group living facility in existence on the effective date of this ordinance may <br />continue in operation despite non-compliance with the criteria contained in the <br />definition of “group living facility” for a maximum of 15 months from the <br />effective date of this ordinance to allow the group living facility to come into <br />compliance with said criteria or to obtain a use permit or special permit. <br />“Guest house” means an accessory building used as sleeping quarters for guests of <br />the occupants of the main dwelling and having no cooking facilities. <br />SUPP. 13 (1-2023) <br />25-8 <br /> <br />
