KERN: Thanks. Just in the definition of a B & B basically it's an accessory use of a single- <br /> family dwelling not exceeding 5 bedrooms with up to 10 guests. Once the guests count exceed <br /> 10 guests it moves more into a lodge or an inn type of a permit. So, it changes obviously just the <br /> B & B won't exceed it but, clearly can come from there. Thank you. <br /> VITOUSEK: Okay, Commissioners any other questions for the applicant? Okay, seeing none. <br /> Would someone be willing to make a motion that encapsulates the revisions that have been <br /> discussed to limit the number of guests to 6 and require the access off of Leimomi? <br /> NEWBERG: Raised his hand. <br /> VITOUSEK: Commissioner Newberg? <br /> NEWBERG: Thank you Chair. I'd like to make a motion to approve the Use Permit for <br /> application 21-000086 provided that the guests would be capped at 6 and that the 7 <br /> recommendations be met on Page 6 of the Recommendation sheet provided by the County. <br /> VAN PERNIS: Raising his hand. <br /> VITOUSEK: Commissioner Van Pernis? <br /> VAN PERNIS: I'd like to offer a friendly amendment to that motion being that as the applicant <br /> has agreed all access both guests and otherwise to the subject property be via Leimomi Street <br /> exclusively. This would mean the Mamalahoa access would be permanently gated and unused. <br /> VITOUSEK: So, I think where we are now procedurally Commissioner Newberg you've made a <br /> motion if you'd like to revise your motion in any way you can do that, but we would need to <br /> have a second on your motion in order to discuss it. <br /> NEWBERG: Yes, with all due respect to Mr. Van Pernis I think the suggestion is good but I'm <br /> comfortable with what has been proposed by the applicant that they will instruct their guests to <br /> access their property as guests through the Leimomi. My feeling is that the spirit of the motion <br /> presented would be acceptable and I hope you'll find it acceptable as well Mr. Van Pernis. <br /> VITOUSEK: Okay, with that we will request a second on the motion so that we can actually <br /> proceed to discussion.
