A DMINISTRATION §2-12.7 <br />(b) A fiscal impact statement for a proposed ordinance that affects the revenues, <br />expenditures, taxes, and fiscal liabilities of the County may be initiated by the <br />director of finance at any time, or upon a council member’s written request <br />submitted to the director of finance no later than 4:30 p.m. on the date of the first <br />required council reading of the proposed ordinance. The director of finance shall <br />submit the fiscal impact statement to the council no later than noon on the business <br />day prior to the second required council reading. Nothing in this section shall be <br />construed to limit the ability of the council to act on a proposed ordinance in the <br />absence of a requested fiscal impact statement. <br />(c) This section shall not apply to any proposed ordinance to amend the Hawai‘i <br />County Charter or to establish the operating budget or capital budget for the <br />following fiscal year. <br />(2021, ord 20-79, sec 1.) 2-12.7 <br />Article 5. Fire Department. <br />Section 2-13. Fire chief; appointment; qualifications. <br />The fire chief shall be appointed by the fire commission and may be removed by the <br />fire commission at its sole discretion. Any motion for removal of the fire chief must <br />contain a statement of reasons, and the fire chief must be allowed to respond to the <br />statement of reasons before being removed. The fire chief shall have a minimum of five <br />years of training and experience in fire control, including at least three years of <br />experience in a responsible administrative capacity. <br />(1983 CC, c 2, art 5, sec 2-13; am 2001, ord 01-109, sec 1.)2-13 <br />Section 2-14. \[Former\] Repealed. <br />(1983 CC, c 2, art 5, sec 2-14.) <br />Section 2-14. Powers, duties and functions. <br />The fire chief shall: <br />(1) Perform firefighting and emergency services in order to save lives and <br />property from fires and from emergencies arising on land, or the sea and <br />hazardous terrain; <br />(2) Train, equip, maintain and supervise a force of firefighting and emergency <br />services personnel; <br />(3) Monitor the construction and occupancy standards of buildings for the <br />purposes of fire prevention and life safety; <br />(4) Provide educational programs related to fire prevention and life safety; <br />(5) Appoint the deputy fire chief and the private secretaries to the fire chief and <br />the deputy fire chief; <br />(6) Appoint members of the department under established personnel rules and <br />regulations, and statutes; and <br />(7) Have such other powers, duties and functions as may be required by <br />ordinance. <br />(2001, ord 01-109, sec 1.)2-14 <br />SUPP. 10 (7-2021) <br />2-8.1 <br /> <br />
