I3X(P <br />1 department shall determine an annual payment by producer <br />2 responsibility organizations that is adequate to cover, but not <br />3 exceed, the department's full costs to implement, administer, <br />4 and enforce this chapter in the next fiscal year, including rule <br />5 making. <br />6 (b) Once the department has established an equitable <br />7 payment schedule pursuant to subsection (a), the department <br />8 shall equally divide the annual payment among the number of <br />9 producer responsibility organizations; provided that the <br />10 department may not assign a share of annual payment more than <br />11 $1,000 to producer responsibility organizations that represent a <br />12 single producer and report less than one hundred tons of covered <br />13 products supplied during the most recent calendar year for which <br />14 such data has been reported. <br />15 <br />(c) By I <br />. and annually thereafter, <br />the <br />16 <br />department shall collect each <br />registered producer responsibility <br />17 <br />organization's payment of the <br />department's cost for the <br />next <br />18 <br />fiscal year. The department <br />shall: <br />19 <br />(1) Apply any remaining <br />annual payment funds from <br />the <br />20 <br />current fiscal year <br />to the annual payment for <br />the next <br />2021-0546 HB HMSO-1 16 <br />
