N0.13\�6 <br />I fiscal year, if the collected annual payment exceeds <br />2 the department's costs for a given fiscal year; and <br />3 (2) Increase annual payments for the next fiscal year to <br />4 cover the department's costs, if the collected annual <br />5 payment was less than the department's costs for the <br />6 prior fiscal year. <br />7 § -4 Department duties; producer responsibility; plans. <br />8 (a) Beginning I . the department may determine <br />9 the responsible party for a covered product when the responsible <br />10 party is not a brand holder, does not import covered products <br />It into the State, or has not elected to assume the responsibility <br />12 for covered products. <br />13 (b) The department shall review new, updated, and revised <br />14 plans submitted by producer responsibility organizations as <br />15 required in section -2.
