NO. %s%e <br />1 <br />(1) <br />Are or may be collected, separated, and processed in <br />2 <br />sufficient quantity and quality into a marketable <br />3 <br />feedstock that can be used in the production of new <br />4 <br />products; <br />5 <br />(2) <br />Contain toxic substances; or <br />6 <br />(3) <br />Are designed in a way that is problematic for reuse, <br />7 <br />recycling, or composting. <br />8 <br />(b) <br />The department may adopt rules pursuant to chapter 91 <br />9 <br />to implement, <br />administer, and enforce this chapter, including <br />10 <br />but not <br />limited to: <br />11 <br />(1) <br />Establishing an equitable formula for determining each <br />12 <br />producer responsibility organization's share of the <br />13 <br />annual payment necessary to cover the department's <br />14 <br />costs, as identified under section -3(a); <br />15 <br />(2) <br />Establishing additional plan content in addition to <br />16 <br />the requirements established under section -11, as <br />17 <br />necessary to fulfill the intent of this chapter; <br />18 <br />(3) <br />Requiring producers to collect and manage covered <br />19 <br />products from additional locations or entities <br />20 <br />determined to be significant sources of covered <br />2021-0546 HB HMSO-1 19 <br />
