N0.13N6 <br />(3) Make a determination in writing as to whether or not <br />to approve a plan, plan update, or plan revision and <br />notify the producer responsibility organization of <br />the: <br />(A) Determination of approval if a plan provides for <br />a program that meets the requirements of this <br />chapter, taking into consideration comments <br />received under paragraph (1); or <br />9 (B) Reasons for not approving a plan. <br />10 The producer responsibility organization shall submit a new or <br />11 revised plan within sixty days after receipt of the letter of <br />12 disapproval. <br />13 (c) The approval of a plan by the department shall not <br />14 relieve producers participating in the plan from responsibility <br />15 for fulfilling the requirements of this chapter. <br />16 § -5 Department duties; covered products; reuse. (a) <br />17 Beginning I the department may develop criteria <br />18 to determine whether the covered products are reusable, <br />19 recyclable, or compostable.
