Page 21 <br />H.B. NO. 13\6 <br />1 (c) The department may adopt rules pursuant to chapter 91 <br />2 to implement, administer, and enforce minimum postconsumer <br />3 recycled content of covered products, and to adjust minimum <br />4 postconsumer recycled content. In making a determination to <br />5 adjust the minimum postconsumer recycled content requirements, <br />6 the department may consider the following: <br />7 (1) Changes in market conditions, including supply and <br />8 demand for postconsumer recycled plastics, collection <br />9 rates, and bale availability; <br />10 (2) Recycling rates; <br />11 (3) The availability of suitable materials and feedstocks <br />12 to meet the minimum postconsumer recycled content <br />13 requirements; <br />14 (4) The capacity of recycling or processing <br />15 infrastructure; and <br />16 (5) The carbon footprint, and other environmental and <br />17 social impacts, of the transportation and processing <br />18 of the recycled material. <br />19 (d) If the department determines that a minimum <br />20 postconsumer recycled content requirement should be adjusted, <br />21 the adjusted rate shall be in effect until a new determination <br />2021-0546 HB HMSO-1 21 <br />
