The department shall not adjust the minimum <br />4 postconsumer recycled content requirements above the minimum <br />5 postconsumer recycled content percentages, as established under <br />6 section -13. <br />7 § -7 Department duties; performance requirements; <br />8 establishment. (a) Beginning F . and no more <br />9 frequently than every five years, the department may by rule: <br />10 (1) Establish additional reuse and recycling performance <br />11 requirements for years not specified in section <br />12 13; <br />13 (2) Add reuse and recycling performance requirements for <br />14 additional material categories not specified in <br />15 section -13; and <br />16 (3) Adjust the reuse and recycling performance <br />17 requirements established in section -13. <br />18 (b) In making a determination to adjust the reuse and <br />19 recycling performance requirements, the department may consider <br />20 the following: <br />2021-0546 HB HMSO-1 <br />
