NO. 1316 <br />1 (1) Covered products supplied into the state in a given <br />2 year is the amount calculated in accordance with <br />3 section -21(b); <br />4 (2) Reused material is the amount of covered product <br />5 managed by the program in the same year that was sold <br />6 or supplied for reuse for their original or similar <br />7 purpose or function; and <br />8 (3) Recycled material is the amount produced from covered <br />9 products managed by the program in the same year <br />10 measured in accordance with subsection (c). <br />11 (e) A producer that does not achieve the reuse and <br />12 recycling performance requirements established in this section, <br />13 either individually or through a producer responsibility <br />14 organization, shall submit a revised plan to the department no <br />15 later than ninety days after submitting an annual report as <br />16 required under section -21, in which the failure to achieve <br />17 the reuse and recycling performance requirements are identified. <br />18 The revised plan shall include changes to the plan specifying <br />19 how the program will be modified to meet the requirements of <br />20 this section. <br />2021-0546 HB HMSO-1 <br />39 <br />
