Page 5 H.B. N0.131G <br />I "Consumer" means a person to whom a covered product is <br />2 supplied that is the intended end user of the covered product. <br />3 "Covered product" means packaging and paper products sold <br />4 or supplied to consumers. <br />5 "Department" means the department of health. <br />6 "Designated for collection" means the covered products sold <br />7 or supplied by a producer that are included in the material <br />8 categories listed in the producer's plan to be collected for <br />9 reuse or recycling. <br />10 "Environmentally sound" means practices that: <br />it (1) Comply with all applicable laws and rules to protect <br />12 workers, public health, and the environment; <br />13 (2) Provide for adequate recordkeeping, tracking, and <br />14 documenting of the fate of materials within the State <br />15 and beyond; and <br />16 (3) Include environmental liability coverage for the <br />17 producers or producer responsibility organizations <br />18 implementing a plan. <br />19 "Flexible plastic" means any covered product made of <br />20 polymers that is flexible in form, including films and <br />21 multilayer laminates. <br />2021-0546 HB HMSO-1 <br />
