"Plastic beverage container" does not <br />3 include rigid plastic containers or rigid plastic bottles that <br />4 are medical devices, medical products that are required to be <br />5 sterile, prescription medicine, and packaging used for those <br />6 products. <br />7 "Postconsumer recycled content" means the content of a <br />8 product made of recycled materials derived specifically from <br />9 postconsumer recycled material sources. <br />10 "Producer" means a person who meets one of the following <br />11 criteria, in descending order of priority, for assigning <br />12 responsibility to meet the requirements of this chapter: <br />13 (1) Is the brand holder of a brand under which the covered <br />14 product is sold, offered for sale, or distributed in <br />15 or into the State; <br />16 (2) Imports the covered product into the State for sale, <br />17 offer for sale, or distribution in the State, <br />18 including remote sale or distribution, such as through <br />19 sales outlets, catalogs, and the Internet, but is not <br />20 the brand holder as specified under paragraph (1); <br />2021-0546 HB HMSO-1 <br />I <br />
