Owners members submit emails authorizing Mr. Smith to represent the Association of <br /> Apartment Owners, which has been distributed by the commission. <br /> Parties in attendance, we have Mr. George Smith, and John Pipan on behalf of the applicant, as <br /> well as Deputy Director Darrow. If you all raise your right hands, I'll swear you in together. Do <br /> you swear or affirm to tell the truth on the matter before the Planning Commission? <br /> SMITH: I do. <br /> PIPAN: (Inaudible—nods in affirmation) <br /> VITOUSEK: Thank you. Our staff Planner Alex Roy, Alex, do you have anything that you <br /> want to add at this point? <br /> ROY: I do not. I'm just here in case there needed to be any, if there was any questions from the <br /> commission. <br /> VITOUSEK: Okay, mahalo. Mr. Smith <br /> SMITH: Yes, sir. <br /> VITOUSEK: Is there anything that you would like to present to the commission in addition to <br /> what you've submitted in writing? <br /> SMITH: Well, I guess, the only thing I would say is that, had I known the intricacies of the <br /> application the first time through, I would have clearly stated that I was authorized by all <br /> persons. On my resubmittal where I did clarify that I was the president of the association, I and <br /> all of the rest of the owners just assumed that that was enough verification that I was <br /> representing our association. <br /> VITOUSEK: No worries, learning process for all of us, I think. I just, I have a question. Do <br /> you have a formal board structure that issues decisions for the president to act on its behalf, or is <br /> this just everybody is in agreement we are good to go? <br /> SMITH: Well, we, we are spread out, of course; our vice president is in Utah, our treasurer is in <br /> Colorado, and I'm here. And we have aI won't say loose but—not highly structured board. <br /> We work together. We make sure we verify everything with each other either by email or by <br /> text, but we wouldn't have ever even thought that we would need a formal statement for <br /> something that's this simple from our perspective. <br /> VITOUSEK: And just for our records, on the emails we received where everybody is indicating <br /> that they authorize you to represent them, does that constitute everybody in the apartments? <br /> SMITH: Yes, that's all the <br /> — <br /> 2 <br /> EXHIBIT C <br />
