Notwithstanding the absence of a commissioned flora and fauna <br /> study, it would appear that this B&B use would not have any <br /> significant negative impact, if at all, on the floral and fauna resources <br /> in the area. This is due to the rural/agricultural character of this area, <br /> as well as the on-going agricultural use of the property. <br /> D. Archaeological Resources, <br /> For the same reasons noted above plus the fact that no land <br /> disturbance activity is being contemplated by the requested uses, no <br /> commissioned archaeological inventory survey and cultural <br /> assessment study was conducted. The past and current agricultural <br /> use of the site and improvements around the dwelling, resulting in its <br /> extensive clearing, reduce the prospect of finding any archaeological <br /> remains. <br /> Nonetheless, during the course of further development of the subject <br /> parcel, should any unanticipated archaeological features or sites be <br /> uncovered, work in the affected area will immediately cease and the <br /> applicant will notify the Planning Department. <br /> E. Valued Cultural Resources <br /> The recent Hawaii State Supreme Court's "PASH" and "Ka Pa'akai 0 <br /> Ke'Aina"decisions require decision-makers to consider a project"S <br /> impact to native Hawaiian gathering and fishing rights. Specifically, <br /> there must be a discussion of the cultural, historical, and natural <br /> resources and associated traditional and customary practices of this <br /> site and the impact of this project to these resources and practices. <br /> In this situation, the subject parcel is not adjacent and/or proximate to <br /> the shoreline. As such, fishing and coastal access is not an issue. <br /> It is not known whether the subject or immediate surrounding area <br /> was ever used for the gathering of plants by native Hawaiians. The <br /> site has been used agriculturally as a coffee farm for nearly, 50 years. <br /> Almost all of the existing vegetation on the parcel now consists of <br /> introduced plant species. As such, it would appear very unlikely that <br /> the site would serve such purpose today and/or in the recent past. <br /> The cultural impacts, if any, thus appear to be non-existent. <br /> Notwithstanding the above, however, in the event documented claims <br /> of gathering are made of this parcel, the applicant will honor them <br /> 12 <br />
