features are known to exist on the subject property nor is the property listed as a historic <br /> site on the State or National Register of Historic Places. There are no known traditional <br /> or customary Native Hawaiian cultural rights being practiced within the subject property <br /> or any known cultural or historic resources existing on the property. The applicant reports <br /> that they believe it is unlikely to find any significant archeological features on the site as <br /> it has previously been fully developed for residential and agricultural uses. <br /> 21. Public Access: There is no public access to any shoreline or mountain areas on the <br /> property. <br /> PUBLIC UTILITIES AND SERVICES <br /> 22. Access: The subject parcel is located on the mauka side of Mamalahoa Highway and is <br /> accessed via Duarte Road, a privately owned approximately 9-foot wide paved roadway <br /> over a 50-foot wide access and utility easement. Nonexclusive access to the subject <br /> property via the 50-foot wide access and utility easement was granted via Grant of <br /> Easement and Covenants to Maintain Easement Agreement dated September 14, 1984. <br /> 23. Traffic: Bed and Breakfast operations are limited by the Zoning Code to a maximum of <br /> ten (10) guests, as such the applicant is proposing to rent out three (3)bedrooms, which <br /> will operate below the ten (10) guest limit and is not expected to impact traffic any more <br /> than 3 occupied bedrooms of a dwelling. The applicant has proposed to schedule guest <br /> check-in and check-out after the AM/PM peak hours. According to the applicant the <br /> proposed development is not anticipated to generate adverse traffic impacts on the local <br /> roadway system. <br /> 24. Water: The applicant reported that the subject property, including all three (3) of the <br /> structures are currently serviced by a master water meter. The applicant submitted a letter <br /> from the Department of Water Supply (DWS) dated April 15, 1977 (attached to P.D. <br /> Exhibit 7) as proof of the authorization for the subject property to be serviced by a master <br /> water meter. However, the document was not executed and according to DWS this use of <br /> a master meter is inconsistent with standards and regulations of DWS. According to <br /> DWS the subject property is considered out-of-bounds. Parcels that are out-of-bounds are <br /> limited to just one (1)unit of water. DWS reports that one (1)unit of water can be made <br /> available to the subject parcel to service just one (1) of the dwelling units. Two (2) or <br /> -4- <br />
