<br />DEFRANCO: Okay. <br /> <br />ANDREWS: Sorry I meant to say the State Land Use designation where you have ag that the <br />site itself is split between the urban designations and the ag zoning. <br /> <br />DEFRANCO: So right. So, in the applicant’s proposal where the pink area is, is where he’s <br />looking to do the commercial use? <br /> <br />ANDREWS: Correct. <br /> <br />DEFRANCO: And in the back he’s looking to do, build some homes. Is that right? <br /> <br />ANDREWS: That’s correct. That’s the proposal. <br /> <br />DEFRANCO: And in the CDP it was sort of looked at in this area that there would be sidewalks <br />here, so people can bike into town to go shopping and then go home. Is that right? But right <br />now, there’s no sidewalks. Right, there’s no sidewalks there now? <br /> <br />ANDREWS: Not currently. Although DPW did request that, and it is part of the conditions. <br /> <br />DEFRANCO: So, if this was to go forwards and they would be putting in the sidewalks. Is that <br />right? <br /> <br />ANDREWS: Yes, so if you if you look at the rezone Condition number G. <br /> <br />DEFRANCO: Yes. <br /> <br />ANDREWS: Prior to issuance of final subdivision approval/final plan approval for the CN <br />zoned area that’s the commercial area. The applicant would be required to pavement widening <br />with concrete curb, gutter and sidewalk, drainage improvement, signs, and markings, and so <br />forth, so that’s part of the condition. <br /> <br />DEFRANCO: Alright and then that brings up my question and I think other people’s drainage <br />and flooding. So, you put in these sidewalks and it’s in a flood zone. What happens when it <br />floods? What happens is there gutters or drains or culverts. <br /> <br />ANDREWS: Yes, some of those design questions could probably be addressed better by the <br />engineers, but there are conditions that do require the applicant to comply with Flood Code <br />compliance. <br /> <br />DEFRANCO: Right. <br /> <br />ANDREWS: So, it will have to comply with County, sorry I’m trying to find the condition, but <br />yeah, it’ll have― <br /> <br />KERN: Chapter 27. <br />11 <br />EXHIBIT C <br /> <br />
