Therefore, no long-term <br />air quality impacts to the project occupants or <br />neighboring residences are anticipated, and the <br />project is in compliance with this section and the <br />Clean Air Act. <br />Coastal Zone Management <br />Yes No <br />All lands in the State ofHawai `i are considered to <br />El ® <br />be within the Coastal Zone Management Area <br />Coastal Zone Management Act, <br />(CZMA). However, consultation with the State of <br />sections 307(c) & (d) <br />Hawai `i, Office of Planning, Coastal Zone <br />Management Program confirms that the State <br />CZMprogram does not review HUD assistance <br />programs for federal consistency. <br />Instead, the authority to implement development <br />regulations in coastal areas is conferred to the <br />counties by the State ofHawai `i (H.R.S. Chapter <br />205A) through the regulation of coastal <br />development within the "Special Management <br />Area" (SMA), as indicated in letters dated <br />November 21, 2008 and June 24, 2004, with the <br />Department of Business, Economic Development <br />and Tourism's Office of Planning (see supporting <br />documentation). These letters indicate that the <br />Hawai `i CZMprogram does not review any HUD <br />assistance programs, grants, or loans for federal <br />consistency, but that CZMregulations relating to <br />actions within the SMA and Shoreline Setback <br />still apply. This approach was re -confirmed by <br />telephone in 2015 and 2019. <br />The Project Area is not located within the <br />Hawai `i SMA zone (see SMA map in Exhibit E), <br />and is not subject to additional county permitting <br />or regulatory requirements. Therefore, the <br />proposed project is in compliance with this <br />section and with the Coastal Zone Management <br />Act. <br />Contamination and Toxic <br />Yes No <br />The Project Site underwent a Phase I ESA in <br />SubstancesEl <br />® <br />February of2021, which found that "There were <br />no observed indications of improper generation, <br />24 CFR Part 50.3(1) & 58.5(1)(2) <br />storage or disposal of hazardous or regulated <br />wastes on the Subject Property. No evidence of <br />hazardous materials or petroleum staining was <br />observed on the Subject Property. No recognized <br />environmental conditions (REQ), historical <br />RECs, controlled RECs, or de minimis conditions <br />
