LINDSEY:We had other things to do that day and this first site inspection was you <br />know again the first thing we had to do that day. She is a staff archaeologist but I think the <br />primary reason I guess she was there because we were on our way to do other things as well. <br />KRUEGER:I see. Have you ever had any discussions with Dean Kaiawe the <br />intervenor in this case? <br />LINDSEY:I believe we had conversations via telephone. <br />KRUEGER:Can you tell us generally what the, how many times? <br />LINDSEY:Generally I€d say two to three times. <br />KRUEGER:Do you remember generally the subject of the discussions? Were the <br />generallythesamediscussions? <br />LINDSEY:Theywerediscussionsregardingthegravesitesonthisproperty.Andhis, <br />I€m sorry, and his connection to those gravesites. <br />KRUEGER:Can you tell me whether or not you discussed with Mr. Kaiawe the types <br />of things that you€ve been testifying here today with respect to Mr. Ibbetson€s use of the <br />property? <br />LINDSEY:Regarding the construction of the home? <br />KRUEGER:Regarding construction of the home the fact that maintaining the <br />gravesites in place and making sure they were safe was satisfactory to you. <br />LINDSEY:I recall discussing ways to protect these sites as construction continued or <br />initiated and continued. I can€t remember the exact details of what we talked about relative to <br />what should be implemented, what sort of protected measures should be in place. <br />KRUEGER:Just for the record again. Did you ever tell Mr. Ibbetson that he was <br />supposed to do certain things during construction that he did not do to protect the gravesites? <br />LINDSEY:I don€t recall.
