KRUEGER:I believe its dated December 13, 2003. Can you tell me what the purpose <br />of that letterwas? <br />LINDSEY:To ensure that Mr. Ibbetson was aware of the gravesites on his property <br />and that their construction of his home should not impact those gravesites on his property. <br />KRUEGER:Is it your opinion that the letter itself was intended to tell Mr. Ibbetson to <br />stop construction on the property? Have you seen a copy? Would you like me to show you a <br />copy of that letter? <br />LINDSEY:Sure. <br />KRUEGER:For the Commissions benefit that is Exhibit L of Mr. Kaiawes exhibits. <br />Ill give you a minute to review that. <br />ALAMEDA:Continue. <br />KRUEGER:Thank you. Mr. Lindsey the letter dated December 17, 2003, I believe I <br />th <br /> <br />saidDecember13 from P. HollyMcEldowneyadministrator to Mr. Ibbetson refers to a March <br />th <br />11 visit to the property. That was the date that you I believe and Mary Anne Maigret went to <br />the property correct? <br />LINDSEY:Correct. <br />KRUEGER:The last paragraph of that letter says you are urged to refrain from any <br />activity that may adversely impact these burials. Is that a standard requestby the State Historic <br />Preservation Division? <br />LINDSEY:Its fairly common. <br />KRUEGER:Okay. Does anything that you read in that letter indicate to you that Mr. <br />Ibbetson should have stopped construction after receiving that letter? <br />LINDSEY:In my opinion no. <br />KRUEGER:Okay.
