I mean I€m sorry, how impacts to the cemetery should be avoided during the construction <br />of his home. <br />KRUEGER:And did you discuss with Mr. Ibbetson the methods of mitigating any <br />impact of the construction? <br />LINDSEY:Yes. <br />KRUEGER:Andwhatdidyou,didyoutellhimwhattodo? <br />LINDSEY:Thatthegravesite,thatthegravesitesthatwebothwerelookingatandthat <br />he knew about shouldn€t be disturbed by the construction. <br />KRUEGER:Okay. Referring to the diagram on the wall to your right. There is a <br />diagram showing a site A and a site B. Are those the 2 sites where you saw the graves located? <br />LINDSEY:Yes. <br />KRUEGER:Okay. Did you know at the time that you went out there to the site that <br />Mr. Ibbetson intended to commence with construction afterwards? <br />LINDSEY:At some point in time afterwards I understood that. <br />KRUEGER:And did you tell him that there was anything further that he needed to do <br />in terms of contacting State Historic Preservation Division or the Burial Council or anybody else <br />having to do with the graves before he commenced construction? <br />LINDSEY:We wanted to stay in touch with him during the course of the you know <br />the initiation of the construction work and the duration of the construction work, to ensure that <br />the site wasn€t being impacted. <br />KRUEGER:Okay. There are exhibits in evidence that show that Mr. Ibbetson applied <br />for and received a building permit for his house in April of 2003 and then for a pool in May of <br />2003. There€s also in evidence a letter from I believe a woman named McIldowny in December <br />of 2003 addressed to Mr. Ibbetson.
