DOMINGO: Yes. Can I make comments since the motion was seconded? <br />KERN: Yeah. <br />DOMINGO: Or is there anything else that you’d like -? <br />KERN: Well, we have the motion that has been seconded. I think since there have been <br />conditions that you wanted to put in there, I think the applicant has the, we need to get those <br />conditions brought forward and have the applicant review those, and see if they’re agreeable to <br />that. While that is taking place, I believe we could have discussion, yes. <br />DOMINGO: Yeah, okay. <br />COTTLE: Mr. Chairman? <br />KERN: But, first of all, let’s see what Maija has to say. <br />COTTLE: Can I hear who seconded the motion? <br />KERN: Commissioner Ishibashi. <br />COTTLE: Okay. All right. So staff has created a set of conditions, and I can just go ahead and <br />read through them, if that’s okay. And you can discuss them. <br />DOMINGO: Mr. Chairman, can we have discussion on the issues at hand; and then when we’re <br />ready to go, to adopt it and take votes, then we can make an amendment to the document. <br />KERN: Yes. With all due respect, for time sake I think we should see what the conditions are, <br />have the applicant be looking at those, and then go into discussion. <br />DOMINGO: Okay. Okay with me. <br />KERN: Okay, thank you. <br />COTTLE: So what we would recommend is our standard first condition that the applicant shall <br />comply with all of stated conditions of approval. We also recommend a condition for plan <br />approval, the standard condition that the applicant apply for Plan Approval prior to commencing <br />the proposed uses, and that’s toensure the landscaping requirements are met and parking is <br />provided. The Commission may want to decide whether to require paved parking or graveled <br />parking. We also would like to include a condition that access to the site meet the requirements <br />of the Department of Transportation. We did ask them for comments but we have not received <br />any comments from them, so it would be wise to just include that standard condition. A <br />condition that the gate at the driveway entrance on Volcano Highway should remain open during <br />hours of operation, so that people don’t stack up on the highway to open and close the gate. A <br />condition regarding the hours of operation. In the application they requested 4:30 a.m. to 7:00 <br />p.m. for the commercial kitchen, so you may want to discuss what those hours should be with the <br />applicant, and possibly the neighbor as well. And then also set the hours of operation for retail <br />activities. Also, a condition that signs associated with the uses should comply with the County <br />Code. And the standard condition that the applicant shall comply with all County, State and <br />Federal laws, rules, and regulations, as well as the time extension condition if other conditions, if <br />they need more time to comply. <br />28 <br />EXHIBIT A <br /> <br />
