COTTLE: That’s how we usually write our standard condition. If the Commission wanted to <br />give, say, six months to comply with the plan approval, they could do that. That way you could <br />operate in the meantime. <br />V. ROBESON: Okay. <br />T. ROBESON: I mean, we have tried to do this the right way from day one. There’s, every <br />recommendation that Planning has made from, you know, when we bought the property, that we <br />had no idea – we made a condition of the sale that everything on that property had to be <br />permitted. And yet when we went through the permit process for the bakery we found out that <br />the greenhouses weren’t permitted. So first thing that we did was go and get them drawn, get <br />engineering approval, submit for plans, you know, and go through that process. So, I’d be more <br />than happy to accept a timeframe to allow us to accomplish that. And I believe we’ve shown in <br />the past that we have lived up to, you know, the desire to meet the requirements. <br />If I can step down a little bit further, the water supply, part of this process of getting the special <br />permit is they, we got comments back. So in those comments was a recommendationto have a <br />certified engineer look at the water flow for both fire and use of the bakery. First off, we don’t <br />come anywhere near using 400 gallons of water a day, a fraction thereof. However, we hired -. <br />MELROSE: Paul Nash. <br />T. ROBESON: Paul Nash to do a study on the water flow and what we were doing; and he’s in <br />that process now. So if we could, again, have an amount of time, we’ve already shown the desire <br />to meet whatever requirements flew down to us. <br />Signs, I mean I understand that. We’ll follow the Code, we’ll apply for permit. I mean that’s <br />normal. <br />MELROSE: You know, I think to summarize, the key issue really is being able to operate in a <br />reasonable period of time and to take some, take whatever time that you’ll grant us to complete <br />the plan approval process without stopping, being able to move into operation. I think you get <br />the sense that these are responsible people who will follow that up. And I will continue to work <br />with them to try and get that accomplished in a reasonable period of time. So if you would <br />provide to that, you know, aperiod in time as Maija suggested, that would be helpful. Six <br />months to comply would be a great thing. Hours of operation, you know, if that’s the will of the <br />Commission, that’s what we had suggested, that’s fine. We want to make sure we meet <br />Mr. Nakao’s interests. It sounds like we’re doing that in spirit and -. <br />T. ROBESON: We need to look at the opening time. You know, and this is based on the <br />testimony that he gave earlier. You know, we applied for 4:30. Maybe that is a little bit too <br />early. You know if the recommendation is to approve with conditions, maybe we set that from <br />4:30 to say 6:00 a.m., which might be a little bit better suited to the timeframe and for what’s <br />going on in the community at those times. <br />KERN: Okay. <br />31 <br />EXHIBIT A <br /> <br />
